Terms of Service

Welcome to Mangowood! These Terms of Service ("Terms") govern your access to and use of our website (mangowood.com) and all related products, applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Use of Services

Eligibility

You must be at least 18 years old and legally able to enter into binding contracts.

Account Registration

You agree to provide accurate, complete, and updated information. You are responsible for activity under your account.

Acceptable Use

You may not use the Services for unlawful or unauthorized activity, including violating any law or regulation, unauthorized data scraping, uploading malware, or violating communication laws such as TCPA, CAN-SPAM, and Do Not Call.

2. Payments and Subscriptions

Some Services require payment. By subscribing or purchasing, you agree to applicable pricing and billing terms. Payments are non-refundable unless required by law or explicitly stated otherwise.

3. User Content and License

By submitting content, you grant Mangowood a non-exclusive, worldwide license to use and process that content as needed to operate and improve the Services. You represent that you have rights to the content.

4. AI Usage and Output Disclaimer

AI features may generate or process content automatically. AI outputs are informational only. You are responsible for verifying their accuracy and legality.

5. Intellectual Property

All intellectual property connected with the Services remains the property of Mangowood or its licensors. You may not copy or modify proprietary materials without permission.

6. Third-Party Integrations

Some Services rely on third-party APIs or integrations (including MLS, IDX, communication). Mangowood is not responsible for third-party actions or data availability.

7. Fair Housing and Licensing Compliance

Real estate professionals using the Services must comply with Fair Housing, advertising laws, and licensing requirements.

8. Communications, Automation, and Legal Responsibility

You are responsible for all messages and phone calls sent or received via the Services and must obtain and keep documented consent for 4 years, honor opt-outs immediately, and comply with relevant laws. Mangowood acts as facilitator for communications between you and third-parties.

You must follow all applicable laws, including:

• Obtained contact information via both legitimate and legal means.
• Obtained express written consent for automated or AI-generated calls and texts (TCPA).
• Valid opt-out mechanisms honored within 10 business days (CAN-SPAM).
• Maintain DNC lists for five (5) years and scrub contact lists.
• Enforce opt-outs across all channels.
• Respect TCPA rules regardless of communication automation level.

You are both solely responsible and liable for compliance to any laws when accessing or using our Services whether manual, semi-automated, or automated.

9. Consent for Marketing and General Communication

By providing your contact information to Mangowood you expressly consent to receive marketing and general text messages, phone calls, e-mails, mail, from Mangowood or our authorized agents. You understand that:

• Consent is not a condition of purchase or service.
• Message frequency may vary.
• Consent includes receiving messages manually sent by representatives without the use of automated dialing systems.
• You may opt out at any time by replying with "STOP" or another reasonable request. Msg/data rates may apply.
• You authorize Mangowood to use your number, e-mail, address for marketing outreach and confirm that you are the subscriber or have authorized use of the number, e-mail, address.
• This consent is captured and stored for compliance with federal and state telemarketing laws.

10. MLS, IDX, and Real Estate Data Compliance

You must be authorized MLS/IDX members to access or use listing data. You must follow all applicable data, display, attribution, and redistribution rules. Mangowood shares participant info with MLS for compliance and access validation as required by MLS rules. Data is provided "as received" with no Mangowood verification. Violations can cause suspension or reporting.

11. Data Protection and Privacy

Mangowood complies with CCPA, CPRA, GDPR, and breach notification laws. You must safeguard any third-party or client data shared through Mangowood.

12. Accessibility and Consent

Consent requests and communications interfaces must be clear and accessible; pre-checked or hidden consents are prohibited.

13. Service Availability

Mangowood strives for reliable uptime but makes no guarantees. Outages may occur.

14. Data Retention Policy

Data is kept as long as necessary, with retention periods as follows: active account data for 24 months post-closure, communication logs for 48 months, billing records for 7 years, system logs auto-purged after 90 days, AI data deleted within 30 days unless in active use. Users may request deletion or data access, which Mangowood will honor within 30 days barring legal retention requirements.

15. Indemnification

You agree to indemnify, defend, and hold harmless Mangowood and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your access to or use of the Services;
• Any data misuse, misrepresentation, or unauthorized activity conducted through your account;
• Your violation of these Terms, applicable laws, or third-party rights;
• Communications with third-parties via our Services

You acknowledge and agree that Mangowood acts solely as a facilitator or intermediary of communications and services requested by you and does not assume any responsibility or liability for the content, legality, or compliance of those communications.

16. Disclaimers and Limitations

Services provided "as is" without warranties; Mangowood disclaims liability for incidental or consequential damages to the extent permitted by law.

17. Dispute Resolution

Disputes resolved by binding arbitration in California under AAA rules; jury and class action rights waived.

18. Governing Law

California law governs without regard to conflicts of law.

19. Updates to These Terms

Terms may be updated periodically, effective when posted. Continued use implies acceptance.

Mangowood Privacy Policy

Mangowood ("Mangowood," "we," "us," or "our"), is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect your information when you visit our website, mangowood.com (the "Site"), and use our products, applications, and services (collectively, the "Services"). By accessing or using the Services, you agree to this Privacy Policy.

Certain data may be categorized as Sensitive Personal Information under applicable laws, including login credentials, payment data, communications content, and geolocation. We limit collection and processing of such data to necessary purposes.

c. Non-Personal Information

Data like browser type, device information, IP address, and usage statistics (pages visited, session duration) may be collected.

d. Cookies and Tracking Technologies

Cookies and similar technologies are used to enhance user experience and analyze traffic. You can control cookie preferences through your browser settings.

2. How We Use Information

We use collected data to:

• Provide, operate, and improve the Services
• Process transactions and provide support
• Personalize your experience and develop new features
• Send marketing communications (you may opt-out anytime)
• Prevent fraud and comply with legal obligations including TCPA and CAN-SPAM

3. AI and Data Usage

Your inputs and outputs generated through AI features may be stored temporarily, generally up to 30 days, unless associated with active projects. We engage third-party AI processors with strict data privacy obligations.

Automated decision-making may be used to personalize experiences; human oversight remains and users may request review.

4. How We Share Your Information

Mangowood does not sell personal information. We share data with:

• Trusted third-party service providers under confidentiality agreements
• MLS or REALTOR® associations (see Section 5)
• Legal authorities where required by law
• Successor entities in business transactions under privacy continuity

5. MLS Participant Data Sharing

If you are a participant, subscriber, or authorized user of any MLS integrated with Mangowood, we may share your participant information—such as name, license number, brokerage affiliation, and MLS ID—with the relevant MLS to facilitate participation, verify compliance, and ensure regulatory adherence. This information is shared solely for MLS-related purposes and subject to MLS privacy policies.

6. Data Retention Policy

We retain data according to these timelines, subject to legal requirements:

• Account data: Active use plus 24 months post-deactivation
• Communication logs: Up to 48 months for compliance auditing
• Billing records: 7 years for financial and tax purposes
• System logs/backups: 90 days with secure deletion cycles
• AI-generated temporary data: 30 days unless attached to active use

Users may request data deletion or access; verified requests are processed within 30 days, except where retention is legally mandated longer.

7. Data Security

We follow industry standards (AES‑256 encryption, access controls) to safeguard your data against unauthorized access or loss.

8. Your Privacy Rights

Based on your location, you may:

• Access, update, correct, or delete personal data
• Opt out from data sale or sharing
• Restrict processing of Sensitive Personal Information
• Obtain data portability
• Withdraw consent for processing based on consent

9. Children's Privacy

Our Services are not designed for, nor do we knowingly collect data from, children under 18.

10. International Data Transfers

Data from users outside the U.S. may be transferred and processed domestically in compliance with applicable data protection laws including standard contractual clauses.

11. Do Not Track Signals

Mangowood does not respond to browser Do Not Track signals.

12. Updates to This Policy

We review and update this Privacy Policy at least annually and notify users of significant changes through our website or email.
